A living will is a legal document which is prepared when a person is mentally competent which will dictate a person's wish not to be kept alive on life support machines after they may become brain dead in a serious accident or from an illness. A durable power of attorney is a legal document which authorizes one person to act on behalf of the individual granting the durable power of attorney to make financial and/or medical decisions on the individual's behalf should the individual become incapacitated. |Durable| means the power of attorney survives if the individual preparing it becomes incapacitated. If no durable power of attorney is prepared and the individual becomes incapacitated, the court will appoint a guardian or conservator to make the decisions.
